Massachusetts revised its DUI / OUI laws as of July 2003 to consider someone with a blood alcohol level over .08 as driving under the influence. However, most simple first time DUI offenders are often charged and handled as "alternative disposition" probation plea bargains. This means that the offender in a mandatory Drug or alcohol education program and their participation in license temporarily suspended.
The law is a little different for offenders under 21 years. According to the law Massachusetts, alcohol consumption by anyone under the age of 21 is prohibited. In addition, the blood alcohol level of people under 21 are not more than 0.02, since 0.08 compared to people over 21 years.
Offenders under 21 years with a blood alcohol level above 0.02 ratio can have their licenses suspended. If the underage offender refuses to take a breath test, the suspension of the license is increased from 180 days to one year.
Almost the same rules apply to offenders under 18. Blood alcohol content of between 0.02 and .04 may include the suspension of the license for 1 year but the result can be reduced if the offender voluntarily enters alcohol and includes a youth center program.
The State of Massachusetts also offers a Driver Alcohol Education Program (DAEP) for people with a first offense DUI charge. Most of the perpetrators involved in this program are referred by area district courts and are placed on probation for the duration of the program. This Program as an alternative to long period without a license to act more severe penalties and in extreme cases, imprisonment.
The program has a guest Receiving 32 hours spread and holds group sessions over 16 weeks, exposure to self-help groups by attending two meetings in the offender? s community and a representation of the effects of DUI on victims by renowned speakers.
Obviously each case, accidents, injuries or death caused by DUI Sentences shows that many are stiffer than a simple DUI arrest. This long custodial sentences are larger and more license suspensions.
