How can Congress pass laws, bankruptcy judges modify mortgage terms on already written?
It seems that would be) challenged (successfully in court because the law when the contract was signed didn't allow modification. I can understand how it could be that the future mandate of mortgages that changed, but not those already written … seems kinda like ex post facto.
1. Ex post facto means that Congress make a law retroactive punitive is prohibited. not to say Congress could pass a law saying that drinking is illegal again and punish people before the law went into effect drank.
